EAC COMPETITION AUTHORITY MERGER INQUIRY NOTICE NO. 2 OF 2026
NOTICE OF INQUIRY INTO THE MERGER INVOLVING GLOBE IN LIMITED AND AFRICAN PORTS & CORRIDORS HOLDINGS.
It is hereby notified in terms of Regulation 8 of the EAC Competition (Mergers and Acquisitions) Regulations, 2025 (hereinafter referred to as the Regulations) that the EAC Competition Authority (the Authority) after receiving a notification in terms of Section 11 of the East African Community Competition Act, 2006 (the Act) involving Globe In Ltd and African Ports & Corridors Holdings (APCH) intends to embark on an inquiry in terms of Part IV of the Act and Part III of the Regulations.
The Transaction involves the proposed acquisition of 49.98% of the issued share capital in African Ports & Corridors Holdings by Globe In Limited from African Infrastructure Investment Fund III, Erik Willem Kok and Jukka-Pekka Karkkainen.
Globe In Limited, the acquiring undertaking, is incorporated under the laws of the Republic of Mauritius as a non-operating holding company that owns subsidiaries in the Republic of Kenya and the Republic of Uganda. Through its subsidiaries, the Acquirer has established dry bulk discharge and handling facilities in Kenya and Uganda. The Acquirer is a provider of cargo handling, terminal operation and logistics services in respect of bulk commodities in Kenya and Uganda.
African Ports & Corridors Holdings (APCH), the target undertaking is also incorporated and registered in Mauritius as an investment holding company. Through its controlled subsidiaries in Tanzania and Zambia, APCH is active in the ports and logistics industry in the United Republic of Tanzania. The Target owns subsidiaries operating in Tanzania and Zambia in the ports and logistics industry, specifically, within the Miscellaneous Port Services (MPS) sector. The target offers quayside supervision, vessel discharge oversight, tallying, sweeping, bulk cargo handling and storage and logistics solutions at the Dar es Salaam Port.
The Authority shall, in accordance with the provisions of the Act and Regulations, determine among other things whether or not the merger is likely to substantially lessen competition within the Community. In view of this, the Authority hereby gives notice to all interested stakeholders, including competitors, suppliers and customers of the merging parties to submit written representations to the Authority with regard to the subject matter of the proposed inquiry by emailing them to: eacca@eachq.org and vokoth@eachq.org All written representations should be sent to the Authority not later than March 20th, 2026.
